Notice to Creditors of Court Orders

Pursuant to Sections 239AT(3) and 239ADO of the Companies Act 1993 (“Act”)

Take notice that on 16 July 2024 pursuant to the judgment of Boldt J (CIV-2024-485-370 (2024) NZHC 1935), the following orders were made in respect of the companies on the application of Ryan Eathorne as administrator:

1. Leave to bring the application to extend the convening period without notice was granted.
2. Pursuant to section 239AT(3) of the Act, the watershed meeting must be convened by 30 August 2024, and the convening period is extended accordingly.
3. Leave is granted to any person who can demonstrate sufficient interest to apply to the Court to modify or discharge these orders on appropriate notice to Mr Eathorne and the Court.
4. The costs of and incidental to the application are an expense incurred in carrying out duties as administrator and are to be paid from the accounts of THL as parent company of the group.
