Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Sophie Watkins Goossens, Land Information New Zealand, declares that, an agreement to that effect having been entered into,

  1. the land described in the First Schedule to this notice is acquired for public sports park purposes and shall vest in the Hastings District Council; and
  2. the easement described in the Second Schedule to this notice is acquired on the terms and conditions set out in the Third Schedule to this notice;

on the date of publication of this notice in the New Zealand Gazette.

Second Schedule

Easement

A right of way for a term of five (5) years from 23 August 2023 over Part Lot 1 DP 7050 (part Record of Title HB198/2) marked E on SO 590452 (“Burdened Land”) appurtenant to the land described in the First Schedule to this notice.

Third Schedule

Easement Rights and Powers

Council and its contractors with all required machinery may use the right of way for the purpose of removing contaminated soil and other materials from the land described in the First Schedule to this notice, and infilling areas.

The rights and powers implied in the specified classes of easement are those prescribed by Schedule 5 of the Land Transfer Regulations 2018 and Schedule 5 Property Law Act 2007, but where these are inconsistent, the provisions of Schedule 5 Property Law Act 2007 will prevail.
