Publication of bankruptcy adjudications and of debtors admitted to a No Asset Procedure changed in December 2018. From that time the Insolvency and Trustee Service has published all adjudications in the New Zealand Gazette by providing a link from the Gazette website to the Insolvency Register.

Notice of Application for an Order of Discharge From Bankruptcy

This document notifies you that, pursuant to Rule 24.37(b) of the High Court Rules 2016:

  1. On 15 May 2023, an application for discharge from bankruptcy was filed in the High Court at Blenheim by Derek Charles West. Its reference number is CIV-2016-406-22 and it is made pursuant to section 294 of the Insolvency Act 2006. The application is to be heard in the High Court at Blenheim on 1 September 2023.
  2. A creditor who intends to oppose the discharge of the applicant from bankruptcy on grounds other than those specified in the Official Assignee’s report (once filed), must file and serve on the Official Assignee and the applicant a notice of the creditor’s intended opposition and the grounds of opposition not less than five working days before the hearing.
  3. The Official Assignee’s report (once filed) and the application, affidavit in support filed under section 296 of the Insolvency Act 2006 may be inspected at the registry of the High Court at Blenheim or at the applicant’s address for service.
